Gas cylinder safety supervision regulations

Decree No. 46 of the General Administration of Quality Supervision, Inspection and Quarantine of the People's Republic of China on "Gas Cylinder Safety Supervision Regulations" has been deliberated and approved by the General Administration of Quality Supervision, Inspection and Quarantine Bureau meeting on April 3, 2003, and is hereby promulgated. Director Li Changjiang April 24, 2003 Provisions on Gas Cylinder Safety Supervision Chapter 1 General Provisions Article 1 To strengthen gas cylinder safety supervision, ensure the safe use of gas cylinders, protect people s lives and property safety, according to the Special Equipment Relevant requirements of the Regulations on Safety Supervision and the Regulations on the Safety Management of Dangerous Chemicals make these provisions.
Article 2 These regulations apply to gas contained in normal ambient temperature (-40 to 60 ), with a nominal working pressure greater than or equal to 0.2 MPa (gauge pressure) and the product of pressure and volume greater than or equal to 1.0 MPa · L, Cylinders for liquefied gases and liquids with a standard boiling point equal to or lower than 60 C (excluding cylinders for fire extinguishing, which are subject to pressure only when extinguishing, and not subject to pressure during storage).
These provisions are not applicable to military equipment, nuclear facilities, aerospace vehicles, railway locomotives, ships and marine installations.
Article 3 The design, manufacture, filling, transportation, storage, sale, use and inspection of gas cylinders used in the territory of the People's Republic of China shall abide by these regulations.
Article 4 The General Administration of Quality Supervision, Inspection and Quarantine (hereinafter referred to as the General Administration of Quality Supervision, Inspection and Quarantine) is responsible for the safety supervision of gas cylinders nationwide. Implement safety inspections.
Chapter II Design and Manufacturing Article 5 The design of gas cylinders is subject to a design document identification system. Gas cylinder design documents shall be identified by an inspection and testing agency approved by the Special Equipment Safety Supervision Agency of the General Administration of Quality Supervision, Inspection and Quarantine (hereinafter referred to as the General Administration of Safety Supervision) before they can be used for manufacturing.
Article 6 When a cylinder manufacturing unit applies for design document identification, it shall submit complete design documents and product type test reports. The cylinder design document should include:
(1) Design task;
(2) Design drawings (including steel stamp impressions);
(3) Design calculation books;
(4) Design specifications;
(5) Standardization review report;
(6) Instruction manual.
When changing the main structure, design thickness, and material designation of the cylinder body, the cylinder manufacturing unit shall reapply for design document identification.
Article 7 The design documents of gas cylinders shall comply with the relevant safety technical specifications and the requirements of corresponding national standards (industry standards) or enterprise standards.
Article 8 Liquefied petroleum gas cylinders shall be designed and equipped with a liquid level limiting device to prevent overfilling; the bottle mouth threads and valve outlets of flammable gas cylinders and auxiliary gas cylinders shall be designed with different left and right thread rotation directions and Internal and external thread structure.
Article 9 For domestic and overseas gas cylinders and their accessories (including gas cylinder valves, pressure reducing valves, liquid level limiting valves, etc., the same below), their domestic and overseas manufacturing enterprises shall obtain a manufacturing license issued by the General Administration of Quality Supervision, Inspection and Quarantine Before engaging in manufacturing activities. The manufacturing permits of gas cylinders and their accessories shall be implemented in accordance with the Regulations for the Supervision and Administration of Boiler and Pressure Vessel Manufacturing.
Personnel engaged in gas cylinder welding and non-destructive testing shall pass the assessment of the safety supervision agency and obtain a certificate before they can perform corresponding work.
Article 10 Cylinders used in China shall be produced in accordance with China's safety technical specifications and national standards (industry standards). When there is no national standard (industry standard) for the time being, an enterprise standard that complies with the requirements of safety technical specifications shall be formulated.
Article 11 Subject to the relevant technical safety standards and national standards for gas cylinders, the manufacturer of gas cylinders may produce gas cylinders with special markings in accordance with the requirements of the cylinder filling unit.
Article 12 Before the gas cylinders and accessories are officially put into production, type tests shall be carried out in accordance with the requirements of safety technical specifications and relevant standards. When the design documents are changed or the main manufacturing process is changed or the production is suspended for more than 6 months, the type test of the gas cylinder shall be carried out.
Article 13 The development and development of new products for gas cylinders and their accessories shall undergo type tests and technical assessments.
Article 14 Cylinders shall be inspected only one by one before leaving the factory (export cylinders shall be implemented in accordance with the contract or other relevant regulations). When the cylinders leave the factory, the manufacturing unit should indicate the manufacturing unit's manufacturing license number and enterprise code mark and the cylinder's factory serial number on the obvious position of the product with a steel seal (or other fixed form), and issue a nameplate to the user one by one. Or other product certificate that can be fixed on the cylinder, issue batch inspection quality certificate by batch. The content of the product qualification certificate and batch inspection quality certificate shall comply with the relevant safety technical specifications and product standards.
Article 15 The manufacturer of gas cylinders and their accessories must be responsible for the safety performance and product quality of the designed and manufactured gas cylinders and their accessories. The cylinder valve manufacturing unit shall ensure that the cylinder valve is used safely at least until the next inspection cycle of the cylinder.
Chapter III Supervision and Inspection of Gas Cylinder Manufacturing Article 16 The inspection agency (hereinafter referred to as the supervision and inspection agency) responsible for the supervision and inspection of gas cylinder manufacturing shall be approved by the General Administration of Quality Supervision, Inspection and Quarantine. The products supervised and inspected by the supervisory inspection agency shall conform to the range of varieties stipulated in the manufacturing license obtained by the inspected unit.
Article 17 The main contents of supervision and inspection include:
(1) Supervising and inspecting important items such as the hydraulic pressure test, the serial number of the cylinder, and the stamping of the supervisory inspection during the manufacture of the cylinder;
(2) On-site supervision and confirmation of the re-inspection of cylinder materials, cylinder burst test, and mechanical and other physical and chemical properties of product samples;
(3) Supervise the operation of the quality management system for gas cylinder manufacturing of the inspected unit.
The gas cylinder manufacturing supervision and inspection report shall include the above three contents and conclusions.
Article 18 The supervisory and inspection institutions shall strengthen the management of supervision and inspection work, and send corresponding supervisory and inspection personnel to complete the supervision and inspection tasks in a timely manner in accordance with the actual production conditions of the inspected units. Inspectors are equipped with the necessary inspection and testing tools to ensure the quality of supervision and inspection work. The supervisory inspection agency shall be responsible for the supervision and inspection report issued.
Article 19 Supervision and inspection personnel shall perform their duties conscientiously, and the supervision and inspection shall be in place. Supervision and inspection shall be carried out in accordance with the requirements of relevant safety technical specifications and standards, and supervision and inspection records shall be carefully prepared. Technical data provided by the inspected units shall be properly kept and kept confidential.
The inspectors who issue the supervision and inspection report shall hold the pressure vessel inspector certificate issued by the AQSIQ.
Article 20 When the supervision and inspection personnel finds that the quality management system of the inspected unit runs out of control and affects the product quality, it shall promptly notify the inspected unit in writing to make corrections and report to the inspection unit's manufacturing license issuing department. When the supervision and inspection personnel finds that there is a safety and quality problem in the parts during the supervision and inspection, they have the right to stop the parts from flowing into the next process.
Article 21 In the process of supervision and inspection, if a dispute arises between the inspected entity and the supervisory inspection agency, it may be brought to the local (municipal) level quality supervision department where the inspected entity is located for handling. If necessary, it can be brought to the superior quality supervision department for processing.
Article 22 The safety supervision agency at the prefecture (city) level quality supervision department where the supervisory inspection agency is located shall conduct supervision and inspection of the supervisory inspection agency and the inspected unit every year. Any problems found that the supervisory inspection agency is unable to perform its duties and the inspected unit evades the supervision and inspection shall be dealt with in a timely manner and reported to the approval department of the supervisory inspection agency and the manufacturing license issuing department of the inspected unit.
Chapter IV Gas Bottle Filling Article 23 The gas bottle filling unit shall submit a written application for filling license to the special equipment safety supervision agency of the provincial quality supervision department. Upon examination and confirmation of compliance, the provincial quality supervision department shall issue a "Cylinder Filling License". Those who have not obtained the "Cylinder Filling Permit" shall not be engaged in gas cylinder filling work.
Article 24 The "Cylinder Filling Permit" is valid for 4 years. Before the validity period expires, the cylinder filling unit shall apply to the original approval department for replacement of the "Cylinder Filling Permit". Those who fail to file an application or are not allowed to replace the "Cylinder Filling Permit" may not continue to fill cylinders after the expiration date.
Article 25 A gas bottle filling unit shall meet the following conditions:
(1) Having a business license;
(2) There are technicians and special equipment operators who meet the needs of gas cylinder filling and safety management, have intact filling facilities, tools, testing methods, and workshops that are suitable for the type of gas to be filled, and meet the requirements Safety facilities
(3) Cylinders with a certain gas storage capacity and a sufficient number of proprietary gas cylinders;
(4) Establishing a sound cylinder filling quality assurance system and safety management system in compliance with the requirements of the relevant technical specifications and safety standards for cylinder filling stations.
Article 26 A gas bottle filling unit shall perform the following obligations:
(1) Provide gas cylinders to gas consumers and take full responsibility for the safety of gas cylinders;
(2) Responsible for the maintenance, maintenance and application of color signs of gas cylinders;
(3) Responsible for making inspections and filling records of gas cylinders in accordance with the provisions of safety technical specifications and relevant national standards, and being responsible for the safety of cylinder filling;
(4) Responsible for the training of filling operators and pre-filling inspectors on gas properties, basic knowledge of gas cylinders, potential dangers and emergency treatment measures;
(5) Responsible for propagating safety use knowledge and danger warning requirements to gas cylinder users, and attaching warning labels and filling labels in compliance with safety technical specifications and national standards on the filled gas cylinders;
(6) Responsible for the inspection of cylinders, and deliver cylinders that do not meet the safety requirements to a cylinder inspection agency designated by the quality supervision department at or above the city (city) level for scrapping and destruction;
(7) Cooperate with the investigation of cylinder safety accidents.
Vehicle gas cylinders, breathing gas cylinders, fire-fighting gas cylinders, non-refillable gas cylinders, and other gas cylinder filling units that have been approved by the safety supervision agency of the provincial quality supervision department shall fulfill the above-mentioned item (c) (4), (5), (7) obligations.
Article 27 The filling unit shall use a computer to file and register the filled gas cylinders with its own property rights, and shall be responsible for coating the filling station mark, the cylinder number and stamping the filling station mark. The filling station logo shall be filed by the provincial quality supervision department. Encourage the safety management of gas cylinders using advanced information technology such as bar codes.
Article 28 A cylinder filling unit shall maintain the relative stability of the personnel filling the cylinder. The person in charge of the filling unit and the person filling the gas cylinder shall pass the examination by the quality supervision department at or above the prefecture (city) level and obtain the certificate of special equipment operator.
Article 29.Cylinder filling units can only fill their own gas cylinders (vehicle cylinders, breathing cylinders, fire-extinguishing cylinders, non-refillable cylinders, and other provincial-level quality supervision departments. Except for gas cylinders approved by the supervisory authority, gas cylinders whose technical files are not in the filling unit shall not be filled.
Article 30 Before and after filling a gas cylinder, the personnel in charge of the filling unit shall inspect the gas cylinders one by one, and if they are found to be overfilled, misfilled, leaked, or other abnormal phenomena, they shall be properly handled immediately. .
When filling, the filling personnel should fill in accordance with the relevant safety technical specifications and national standards. For gases that are not listed in the safety technical specifications or national standards, an enterprise filling standard should be formulated and filled according to the filling factor or filling pressure specified in the standard. Never refill a used non-refillable cylinder.
Article 31 A gas bottle filling unit shall ensure that the quality and quantity of the filled gas meet the requirements of safety technical specifications and relevant standards.
Article 32 No unit or individual is allowed to modify gas cylinders or use them after refurbishment.
Article 33 The safety supervision agency of the prefecture-level (municipal) quality supervision department shall conduct annual supervision and inspection of gas bottle filling units within its jurisdiction. The contents of annual supervision and inspection include: the number of self-propelled gas cylinders, steel stamps and filings, the filling and periodic inspection of self-propelled gas cylinders, and the person in charge of the filling unit and the filling personnel's certificate. The cylinder filling unit shall submit the above materials every year in accordance with the requirements.
The prefecture (city) level quality supervision department shall report the results of the annual supervision and inspection to the provincial level quality supervision department every year. For filling units that fail to pass the annual supervision and inspection, the filling permit shall be revoked, and the provincial quality supervision department shall be requested to revoke the filling permit.
Chapter 2 Inspection Regulations Edit Chapter 5 Periodic Inspection of Gas Cylinders Article 34 The periodic inspection period and scrap period of gas cylinders shall comply with the relevant safety technical specifications and standards.
Article 35 The inspection agency undertaking the periodic inspection of gas cylinders shall be subject to the approval of the safety supervision agency of the General Administration of the People's Republic of China, and shall be engaged in the periodic inspection of gas cylinders in accordance with the relevant safety technical specifications and national standards.
Inspectors who are engaged in the regular inspection of gas cylinders shall pass the assessment of the safety supervision agency of the General Administration of the People's Republic of China and obtain the cylinder inspection personnel certificate before they can engage in the inspection of gas cylinders.
Article 36 The period of validity of the periodic inspection certificate for gas cylinders is 4 years. Before the expiry of the validity period, the inspection agency shall apply to the license-issuing department for the procedures for renewing the license. If no application is made before the expiry of the validity period, it shall not continue to engage in the regular inspection of gas cylinders after the expiry of the period.
Article 37 A gas cylinder inspection agency shall have a site, a residual gas recovery and treatment facility, inspection equipment, and a certificated inspection personnel that are suitable for the type and quantity of cylinders to be inspected, and shall have a certain inspection scale.
Article 38 The main duties of a regular inspection agency for gas cylinders are:
(1) Carry out regular inspections of gas cylinders in accordance with relevant safety technical specifications and standards for periodic inspection of gas cylinders, issue inspection reports, and be responsible for their correctness;
(2) According to the relevant national standards of gas cylinder color marking, remove the paint color on the surface of the gas cylinder and re-apply the color marking of the gas cylinder, and periodically check the steel seal of the gas cylinder;
(3) Destructive treatment of waste gas bottles.
Article 39 A gas cylinder inspection agency shall carry out regular inspections strictly in accordance with the items specified in the relevant safety technical specifications and inspection standards. Before inspecting the gas cylinder, the inspector must confirm the medium handling of the gas cylinder, and the inspection can only be performed after the relevant safety requirements are met. The inspectors shall carefully make inspection records.
Article 40 The gas cylinder inspection agency shall ensure the quality and safety of the inspection work, and ensure that the gas cylinders that have passed the inspection and the gas cylinder valves that have been repaired can use the inspection cycle safely. To be scrapped.
Article 41 The gas cylinder inspection agency shall destructively report the waste gas cylinders that fail the inspection. The destructive treatment of gas cylinders must be carried out by crushing or disassembling the cylinder. It is forbidden to give the waste gas bottle which has not been destructively disposed to others.
Article 42 The gas cylinder inspection agency shall, in accordance with the requirements of the provincial quality supervision department's safety supervision agency, report the number of various gas cylinders inspected in the current year, the number of gas cylinders submitted by each filling unit, the inspection work and the impact gas. Chapter VI Transport, Storage, Sales and Use Article 43 Units that transport, store, sell and use gas cylinders shall formulate corresponding gas cylinder safety management systems and accident emergency treatment measures, and have a special person responsible for gas cylinder safety work , Regularly carry out gas cylinder safety technology education for gas cylinder transportation, storage, sales and use personnel.
Article 44 The transport unit of inflatable gas cylinders must strictly abide by the relevant regulations of the state for the transportation of dangerous goods.
When transporting and loading and unloading cylinders, they must be fitted with cylinder caps (except those with protective covers) and shock-proof rings (except for container cylinders).
Article 45 Units storing gas cylinders shall have special warehouses to store gas cylinders. The cylinder storage shall meet the requirements of the "Code for Fire Protection in Building Design", and the storage quantity of cylinders shall comply with relevant safety regulations.
Article 46 The sales unit of gas cylinders or bottled gas shall sell qualified gas cylinders manufactured by enterprises with manufacturing licenses and bottled gas filled by units that have obtained a gas cylinder filling license.
Cylinder manufacturing units are encouraged to sell cylinders directly to filling units that have obtained a cylinder filling license.
Gas bottle filling units shall purchase qualified gas bottles manufactured by enterprises with manufacturing licenses, and gas users shall purchase bottled gas filled by units that have obtained a gas bottle filling license.
Article 47 Cylinder users shall observe the following safety regulations:
(1) The correct use of gas cylinders in strict accordance with relevant safety use regulations;
(2) It is not allowed to weld the cylinder body or change the steel seal or color mark of the cylinder;
(3) Do not use scrapped gas cylinders;
(4) It is not allowed to invert the gas in the gas cylinder to other gas cylinders or directly fill the gas cylinders by tankers;
(5) Do not dispose of the residual liquid in the gas cylinder by yourself.
3 Punishment Regulations Chapter VII Penalty Regulations Article 48 If a cylinder filling unit commits one of the following acts, it shall be ordered to correct and a fine of 10,000 yuan to 30,000 yuan shall be imposed. If the circumstances are serious, the filling shall be suspended until its filling license is revoked.
(I) Filling non-proprietary gas cylinders (except gas cylinders for vehicles, gas cylinders for breathing, gas cylinders for fire fighting, non-refillable gas cylinders and other gas cylinders approved by the safety supervision agency of the provincial quality supervision department) ;
(2) refilling used non-refillable cylinders;
(3) Failure to carefully check the steel seal and color mark of the cylinder before filling, and filling the cylinder without checking the remaining gas in the cylinder or withdrawing the residual liquid in the cylinder, causing the cylinder to be incorrectly installed or overfilled;
(4) Refitting gas cylinders and refurbishing waste gas cylinders;
(5) Failure to affix warning labels for cylinders and filling labels for cylinders;
(6) The person in charge or filling staff has not obtained the certificate of special equipment operator.
Article 49. Cylinder inspection agencies shall directly return cylinders for inspection or resale to other units or individuals without destructive treatment for cylinders that should be discarded if they fail the regular inspection. A fine below 10,000 yuan. If the circumstances are serious, the qualification for inspection shall be cancelled.
Article 50 A gas cylinder or bottled gas sales unit or individual who commits one of the following acts shall be ordered to make a correction and a fine of less than 10,000 yuan shall be imposed.
(1) selling gas cylinders manufactured by units without a manufacturing license or selling bottled gas filled by unauthorized filling units;
(2) The acquisition and sale of waste gas cylinders without destructive treatment or used non-refillable gas cylinders and other gas cylinders that do not meet safety requirements.
Article 51 A gas cylinder supervision and inspection agency shall be ordered to make corrections if it commits one of the following acts; if the circumstances are serious, its qualification for supervision and inspection shall be cancelled.
(1) The quality control system for supervision and inspection is out of control, and one-by-one supervision and inspection of gas cylinders has not been implemented;
(2) where the supervisory inspection items are incomplete or a false supervisory inspection report is issued without supervisory inspection;
(3) The gas cylinders that have passed the supervision and inspection have serious safety and quality problems, which have led to the suspension of the manufacturing license of the inspected unit.
Article 52 Other illegal acts in violation of these regulations shall be punished in accordance with the Regulations on Safety Supervision of Special Equipment.
Article 53 An administrative counterpart who refuses to accept an administrative penalty may apply for administrative reconsideration or file an administrative lawsuit in accordance with the law.
Chapter VIII Supplementary Provisions Article 54 When an accident occurs in a gas cylinder, the unit and the safety supervisory agency that reported the accident shall promptly report the accident and investigate and deal with it in accordance with the "Regulations for Handling Special Accidents of Boiler Pressure Vessel and Pressure Pipeline".
Article 55 Each provincial quality supervision department may formulate implementation measures in accordance with these regulations and in combination with the actual conditions in the region.
Article 56. The General Administration of Quality Supervision, Inspection and Quarantine shall be responsible for the interpretation of these regulations.
Article 57 These Provisions shall enter into force on June 1, 2003
