Procedures for manufacturing permits for electromechanical special equipment

Article 1 The manufacturing license shall be carried out in accordance with the following procedures and Articles 12 to 16:
(1) Where the method of manufacturing license is product type testing, the procedures for manufacturing license are: application, acceptance, type testing, filing, and announcement. After completing the filing in the prescribed procedures, the application unit can officially sell the special equipment that has obtained the license.

Article 2 Application
特种设备 安全监察机构(以下简称受理机构): Applicants who, after self-assessment, consider that they have the conditions specified in Chapter II of this rule shall submit the following application materials to the special equipment safety supervision agency (hereinafter referred to as the accepting agency) that accepts the application for manufacturing licenses specified in the Catalog :
(1) A copy of the legal person's business license of the applicant;
(2) "Application for Special Equipment Manufacturing License" (hereinafter referred to as "Application");
(3) The quality manual of the applicant.
Before the application unit submits an application for a manufacturing license to the accepting agency, it shall submit the application materials to the special equipment safety supervision agency at the next lower level of the accepting agency where the unit is located to confirm the application materials. The safety supervision agency that confirms the application materials shall not organize a preliminary review of the application unit.
The applicant for importing special equipment is a manufacturing plant or an agent that complies with Article 10 of the "Special Equipment Quality Supervision and Safety Supervision Regulations."
   
 
Article 3 Acceptance
After receiving the application, the accepting agency shall process the application in accordance with the following regulations within 15 working days:
(1) In any of the following cases, a decision not to accept the application shall be made and the applicant shall be notified in writing:
1. Units with incomplete application materials or failing to meet the conditions specified in Chapter II;
2. Units whose application materials are not true and cannot meet the conditions stipulated in Chapter II;
3. Before the application was filed, a unit that had any of the conditions in Article 28 other than paragraph 6 within two years;
4. Units that are in judicial disputes such as legal proceedings that have an adverse effect on the processing of the Manufacturing License or are receiving relevant judicial restrictions and penalties;
5. Organizations engaged in type testing, supervision and inspection, periodic inspection or review of related special equipment.
(2) Any unit that does not fall into the above circumstances shall make a decision to accept the application, sign the application acceptance opinion on the "Application Form", and notify the applicant unit.
   
 
Article 4 Type test
Applicants may request a type test institution that meets the requirements of Article 4 to perform type tests. The requested type testing institution shall promptly provide the type testing procedures to the applicant unit, and notify the relevant information required for the type testing and the conditions that shall be met. Generally, a type test report should be issued within 30 working days.
If the manufacturing license is a product type test, the applicant who obtains the type test qualification report can summarize the "Application Form" and the type test report and submit it to the accepting agency.
When applying for a manufacturing license for the first time, if the performance test of the complete machine for type testing must be performed after installation at the site of use, the applicant should submit a written application, which should be confirmed by the type testing agency and approved by the special equipment safety supervision agency of the provincial bureau where the equipment is installed. An installation unit that has obtained the corresponding qualifications can install one sample required for type testing at the site of use. After the type test is qualified and the unit has obtained a manufacturing permit, the special equipment can be registered for use and put into use.
The installation of more than two (including two) samples shall be approved by the special equipment safety supervision agency of the General Administration.
   
 
Article 5 Review of Manufacturing Conditions
(1) After the applicant has obtained the type test qualification report, it may hold the following materials, and invite the evaluation agency that meets the requirements of Article 4 to conduct the evaluation of manufacturing conditions:
1. Signed the "Application Form" for accepting application opinions;
2. The quality manual of the applicant;
3. Type test qualification report.
The appraisal agency shall provide the applicant with the Appraisal Record and the appraisal guide in a timely manner. After self-assessment is passed, the applicant unit may negotiate with the review agency to determine the on-site review time, and must notify the provincial bureau of special equipment safety supervision agencies where the on-site review time is located. The special equipment safety supervision agency of the Provincial Bureau may appoint a special equipment safety supervisor to the scene to supervise and assess the quality of work on site.
(2) The on-site review is conducted by a review team composed of review agencies. The review team consists of two or more (including two) reviewers who have passed the assessment of the special equipment safety supervision agency of the General Administration and invited experts (when necessary), generally 3 ~ 5-people.
(3) The review includes assessment and review of the basic manufacturing conditions and the establishment and operation of the quality management system. The review team shall conduct the review item by item according to the review items in the Review Record, give the individual review results and fill in the Review Record. At the end of the on-site review by the review team, a preliminary draft of the Special Equipment Manufacturing Condition Appraisal Review Report (Annex 4, hereinafter referred to as the “Review Report”) with the assessment opinions of the review team completed shall be issued to notify the applicant and request the person from the applicant's presence to sign.
(4) The review agency shall, based on the review report and assessment opinions of the review team, approve the conclusions of the Review Report after approval by its responsible person. The conclusions of the review are classified as qualified, basically qualified and unqualified:

2. Basic conditions
The "Appraisal Record" applies to all important projects that are in compliance, non-important projects that have non-conformities and defects, but those who believe that the rectification can meet the requirements within 6 months can be rated as basically equipped;
3. Not qualified
Those who fail to meet the basic requirements shall be assessed as unqualified.
(5) The applicant shall, within six months, make rectification of the non-compliances and form a rectification report and submit it to the original review organization for re-evaluation within 6 months. When the re-evaluation of all applicable projects is met, it shall be rated as qualified; otherwise, it shall be rated as not qualified.
(6) If the evaluation conclusion is not met after the evaluation or re-evaluation, the evaluation agency shall report to the accepting agency within 10 working days after completing the on-site evaluation.
(7) Within 15 working days after the completion of the on-site review, the review agency shall timely compile the “Application Form”, the type test qualification report, the “Review Record” and the “Review Report” with the review conclusion signed, and the review report after the correction The “review report” and the “review report” (if it is reviewed) with the conclusion of the review shall be submitted to the accepting agency.
   
 
Article 6 Filing or Examination and Issuance
After receiving the appraisal and evaluation materials for product quality or manufacturing conditions, the accepting agency shall conduct an examination in accordance with the provisions of this rule, and make a decision on whether to record it within 5 working days or whether to issue a Manufacturing License within 30 working days. . Those who pass the examination shall go through the product type test filing or issue the Manufacturing License; those who fail the examination shall be dealt with in accordance with the following provisions:
(1) If the working procedures of the evaluation agency or type testing agency do not meet the requirements, or the materials provided are incomplete due to the reasons of the two institutions above, the corresponding evaluation agency or type testing agency shall be instructed to integrate the procedures or supplement the materials within the prescribed period and re-examine. In such cases, the applicant shall be notified in writing at the same time.
(2) If the working procedures of the appraisal agency and type test agency are in compliance with the requirements, and the application materials are not true or can not meet the conditions stipulated in these rules, a decision to disapprove shall be made, and the reasons shall be explained to the applicant in writing.
   
 
Article 7 The Manufacturing License is issued by the General Administration of Quality Supervision, Inspection and Quarantine. If the provincial-level quality and technical supervision administrative department is entrusted to accept, review, and handle the Manufacturing License, the certificate must also be uniformly produced by the special equipment safety supervision agency of the General Administration, uniformly numbered, and stamped by the General Administration. The provincial quality and technical supervision administrative department shall, within the first week of each quarter, submit a copy of the certificate issued by the department within the first quarter before this report to the special equipment safety supervision agency of the General Administration.
The accepting agency shall establish a file management system for the issuing unit, and keep the "application" and necessary witness materials. The appraisal agency shall keep all relevant materials for the review of manufacturing conditions.
   
 
Article 8 The units, products and their license scopes that have obtained manufacturing licenses shall be announced to the public by the General Administration of Quality Supervision, Inspection and Quarantine.
